JONES V. DE LAROSIERE
This story which I found on www.courttv.com is about a mother who lets her daughter have an open house party on their property in the backyard and it gets out of hand. The police break the crowd up and while their leaving a bunch of kids start a fight a few blocks away and one ends up dead. Adam Jones was a young boy who was at this party with his friends and after the party broke up was walking to their car when another boy walked by. Somehow, it is unsure how, these boys ended up in an argument. After that the other boy's friends showed up and the two groups of youngsters started fighting. Adam Jones died and another boy, Derrick Acklin, was convicted of felony battery and sentenced to four years in prison.
Mr. & Mrs. Wes Jones filed a $10 million lawsuit against the de Larosieres, claiming they were criminally negligent in allowing alcohol to be served, which led to the deadly fight that caused Jones' death.
Adam Jones brought his own alcohol so as far as the de Larosiere's alcohol serving party goes, that is irrelevant, but I still think that some sort of justice should have come out of this. In no way should the de Larosiere's have a party where alcohol is served to minors. I think the decision to not find them responsible for Adam Jones' death was right, but the de Larosiere's should get some punishment for having the party to begin with. The mother claims she did not know alcohol was being served, but that was because she was in the kitchen away from the party. If you have a party for your children, especially high school kids, you would think as an adult you would take some responsibility and be outside checking to make sure nothing illegal was happening on your residence. They should be held liable for serving alcohol to minors even if they were not aware of it because they should have been supervising the event, not just staying on the property at the same time, and not watching what the kids were doing. Any parent knows that the instant you take your eyes away from your kid, that's when they get into something they are not suppose to. The only way to prevent it is to make sure you keep your attention on your kids.
